Aughnacloy (Border) - Londonderry
|Dual Carriageway||The Minister announced the appointment of contractors for the scheme on 7 December 2009. RoI funding was deferred on 10 November 2011. The Minister announced funding for sections between Londonderry to Strabane and Omagh to Ballybawley on 14 February 2012. The Minister announced decision to proceed with two sections on 31 July 2012. Notice of Intention to Proceed, Notice of Intention to make a Direction Order and relevant Notice of Intention to make a Vesting Order published in August 2012. Legal challenge received on 10 September 2012. Judge rejected all but one of the challenges on 12 March 2013. This related to the Habitats Regulations and the Judge took the view that a fuller assessment of the impact of the A5 proposals on the Rivers Foyle and Finn Special Areas of Conservation should have been carried out. At a further hearing on 8 April 2013, the judge ruled that the Orders were quashed. The Minister decided not to appeal. Since then, four reports to inform on the Appropriate Assessment process have been developed to assess any impacts on the integrity of all designated environmentally sensitive sites (9 in total) in the vicinity of the scheme and where appropriate, mitigation measures are proposed. Consultation on three of the four reports commenced on the 30 April 2014. Consultation on the fourth report associated with the Appropriate Assessment for the Tully Bog Special Areas of Conservation is expected in September 2014. The first three Habitat Assessment Reports (HAR) have been published with public consultation carried out during the period of 30 April 2014 to 16 June 2014. The fourth HAR was published on 24 October 2014.||
